Constitutional Court agreed on rules in how to proceed with review of appeals from non-elected judges and prosecutors

With 13 votes “for” and one “against”, Constitutional Court yesterday agreed on rules on how to proceed with review of the appeals filed by non-elected judges, prosecutors and thir deputies.

According to the President of the Constitutional Courts, Dr. Bosa Nenadic, all hearings will be public.

The Constitutional Court will also invite representatives of the High judicial Council, as well as persons who filled appeal. Both sides will have an opportunity to comment on the appeal. Discussion will be time limited but both sides will be given a chance to stake their case. Judges of the Constitutional Court will also have an opportunity to ask both sides questions related to the particular case.

All judges of the Constitutional Court will be informed of the decision of the HJC and not only the reporting judge. The first to be reviewed under the new rules will be appeals of those judges which have received personal justifications from HJC and SPC, and their number is approximately 220.

On the question when can we expect to start with hearings, Dr. Bosa Nenadic said that she is ready and that starting today she will schedule hearings.
“It is now all in the hands of the reporting judge” – she said.
